Digital marketing agency Rise Interactive agreed to settle a class action lawsuit in relation to a data breach in 2022 that exposed sensitive information of its customers.
The breach involved both Rise Interactive and Edgepark Medical Supplies which only informed customers in November 2022 that their personal data may have been compromised.
The breach reportedly exposed a variety of sensitive data, including names, email addresses, phone numbers, health provider information, medical diagnoses, expected delivery dates, and health insurance details.
According to plaintiffs, Rise Interactive failed to take reasonable cybersecurity measures to protect this information.
Although neither Rise Interactive nor Edgepark Medical Supplies, a provider of medical products, have admitted to any wrongdoing, both parties have agreed to pay an undisclosed amount to resolve the lawsuit.
Settlement terms
Under the terms of the settlement, individuals who were notified by both companies that their personal data may have been impacted by the 2022 breach are eligible for compensation.
Class members may receive reimbursement of up to $250 for out-of-pocket expenses related to the breach, such as bank fees, communication charges, travel costs, or losses from identity theft and fraud.
Additionally, affected individuals are entitled to a pro-rata cash payment from the settlement fund, which is estimated to be around $50 but could vary depending on the number of claims filed.
To be eligible for settlement benefits, affected individuals must submit a valid claim form by February 18, 2025. The deadline to exclude oneself or object to the settlement was January 20, 2025. A final approval hearing for the settlement is scheduled for March 11, 2025.
Individuals seeking compensation will need to provide documentation of their losses, such as receipts, bank statements, or credit card statements. The total amount of compensation could reach up to $300, depending on the reported losses.
